Who's right: First to Publish?

LOGOS AND LOGIC

Our new trademark logo that is currently in the process of being IP protected.

The law has so many competing facets, no one can really be confident their business is safe from competitors; both innocent and not so innocent. To actually achieve a "registered" trademark = ® you must submit the mark or word etc. to IP Australia and pay your non-refundable fee and spin the wheel! To achieve "copyright" = © you have to publish an original work in the public space. To use "trademark" = ™ simply means you are letting others know you are using a trademark rather than just a description, that is not registered under IP Australia's registration system.

It would be nice if all these trademarks weren't necessary! But Google changed the way advertisers once operated in the Appliance Repair industry. Yellow Pages used to be it and a bit if you wanted to be successful. It was printed once a year and so competing advertisers were locked in or out for at least 12 months. Google's cycle is 24/7 and so competitors can come up with a great name today and be advertising the same day. With Google Ads they can be at the top of the page on the same day!

We started as Adelaide Whitegoods Specialists only to learn that Google searchers (you) don't use "Whitegoods" anymore or "Specialists" for that matter. So we quickly registered the trading name "Adelaide Appliance Repairs" which is unlikely to be the no.1 search term for appliance repairs anymore. However, it also meant we'd struggle to meet customers expectations with such a generic coverall name. Customers want a repairer who can turn up with the right parts and complete the repair on the first visit. To do that we'd need an 18 wheeler semi-trailer to hold all the parts needed for Ovens, Dishwashers, Washing Machines, Cooktops and so on. Hence, we registered "Adelaide Oven Repairs" the number 2 search-term back then. "Oven Repairs Adelaide" was the no. 1 search-term. And away we went! Building a dedicated oven repair business that would allow us to complete more than 95% of repairs on the first visit.

It didn't take long for our competitors to catch on and start using our business name in their 'Search Result Titles' causing customers to think they were getting us, but in-fact were getting our competitors. So, in an effort to keep our competitors from causing this confusion in the market place, we registered what we thought were sufficient domain and business names to create a moat around our core business!

Turns out, at best we're maybe slowing them down! And maybe that is the best we can hope for in the current internet construct!

THE NAMES AND LOGOS

Almost all business marketing is done online these days! Almost all searches are done on Google these days! Almost all our competitors use some form of Adelaide, Oven, Repairs in their search result titles! Why so many Business Names, Domain Names, Brands, Logos etc? Because the internet is still very much like the wild wild west! Having a registered business name does not stop the competition from buying a domain name of the same address. Owning the domain name does not stop the competition from registering a business name of the same registration. Owning one or more of these does not stop the competition from registering a Trademark® using the same words in a logo. Google; who is the current king of our universe when it comes to attracting and winning customers, allows almost everything that the real world might consider 'Misleading' - 'Deceptive' - 'Passing Off'! Google don't allow it on purpose, because much of the government regulations are set at cross purposes. We own the business name 'Adelaide Oven Repair' and the domain of the same address. That doesn't mean competitors can't use those words to describe what they do. However, IP Australia has a different set of rules. 'Oven' the appliance we service in 'Adelaide' or 'SA' and the fact that I am a 'Man' are not registerable now according to IP Australia because a competitor has registered these trademarks in November 2023.

The heart of the question is this! Does the brand, logo, business name etc. bear enough similarities that the customer has become confused about who they are dealing with. Is the name Adelaide Oven Repairs the same as Oven Repairs Adelaide. Business Names (CBS) say yes. Google says yes. But does a potential customer; we say no! Hence why we publish our logos and have so many. We are trying to make sure that our customers know who we are when the see our logos, mascots, advertising materials. Are there too many? Yes! Is there another way to manage this; for sure! But can a small business run a media campaign to make sure all their potential customer are informed; absolutely not. So we do what we can to combat those trying to muscle in on our patch.

How can you be sure you're getting us, and why does that matter? Read On! The other reason we post these logos/trademarks/copyright works is to publish them in the public space. By having these here, they establish a publish date and that they are unique, in that they have not been used or published elsewhere before us. Owning the domain names is also another barrier to others who would like to usurp our no. 1 position in Adelaide's Oven Repair market. Our competitor registered the trading name "Adelaide Oven Specialists"; only to learn that we already owned the domain name www.adelaideovenspecialists.com.au. Which in real life had the effect of stopping our competitor trying to trademark that name.

The symbolism of our branding

Why we've chosen different elements for our brands, logos, symbols

OUR BRAND DESIGNS

When you see these symbols they are part of our story and evolution as we attempt to keep up with Google's constantly changing criteria for ranking high on the "organic" search results. These symbols have meanings; mostly they are taken from the conceptual idea for representing the dials of an oven, which allow you to control function, temperature or time. The Z is an electrical designation for impedance. Almost the first thing you learn at trade school as an electrician is (Ohms Law Ω) represented as "V=IR". (Impedance Z) is "Z=V/I". We have tried to build into our brands, logos and other marketing materials unique identifiers that help build our reputation in the market place. By being the first to publish these logos, symbols, mascots and brands imbues copyright protection for the original author which prohibits others from using these without authorisation. They become trademarks when published and should act as customers assurance that they are dealing with us, the intended business.
